Data migration: what are we allowed to do?

In discussions both within my team and with potential customers, a topic that keeps popping up is data migration from other EHRs. Medical data is, of course, an extremely sensitive issue and could have unwanted legal complications, never mind the technical issues that could arise (custom file formats etc). Which types of data are we typically allowed to transfer from an already existing application to our service? Demographics only, or the complete records too? This is important, because a competitor named “Computer Solutions” here in Greece has already sued another company that migrated data for a clinic (the clinic abandoned Computer Solutions’ application and bought another - and asked the new company to migrate the data), accusing them of violating privacy legislation. What actions would you take to protect yourselves from litigious competitors?

Guessing this is going to be very dependent on local laws and contracts that were signed. Seems awful, though, that a company is getting sued for simply transferring patient data to another EMR; another great reason to use an open source EMR.
