Certified OpenEMR and ONC Rebranding Rules

There are very specific legal obligations around certification and eligibility for ARRA Meaningful use remittances for your customers.   Forks of the project can not claim to be certified by “being based on OpenEMR”, they must be identical to the certified release except for logo/splash page branding.

OEMR is responsible to the ONC-ATCB for approval and monitoring of ‘rebranded’ versions of OpenEMR, you must contact the board prior to making any claims.   Version 4.0.0 Release is the currently certified release.   Being a member the OEMR 501©(3) will be an important part of this process.  http://wiki.oemr.org/wiki/Main_Page#OEMR_a_501.28c.29.283.29

Note: This whole thing only applies if you are selling/offering your version under a different name.  IF you call it OpenEMR version 4.0.0  and you just include your company logo on the splash screen then you *aren’t* rebranding.
